Protecting your Website Legally From the Music Industry

In the connected world, where businesses pop up like dandelions and anyone with a computer can upload video, audio and text-based content to be shared across the web, it is of growing importance to understand the potential legal ramifications associated with these technical advancements.

Most internet businesses make use of some sort of rich media on their websites such as video or music. What most don’t realize is that even the smallest S-Corp can find itself in hot water if it doesn’t understand the basics.

What is production music?

Production music libraries cover a multitude of genres, providing music for most tastes at varying levels of quality. Traditionally, production music comes in shorter lengths. These lengths are normally 30 seconds, 60 seconds and 90 seconds.

Production music also comes in different variations known as full and reduced versions. Reduced versions are identical to full versions with the exception of one or possibly two of the main instruments having been removed.

Who uses production music?

Production music is most widely used by industry experts like; video editors, producers, music supervisors, videographers, and creative directors. Although increasingly, it is being used by relative amateurs for websites, podcasts, streaming video and more.

How do I Get a License?

Something called a Synchronization License or Sync License must be obtained for the music in question before it can be utilized in any audiovisual production, such as a motion picture, television program, television commercial, video production, or website.

Sync Licenses come in different shapes and sizes. Two of the most popular are a Drop License and Blanket License. They are most commonly made available by production music publishers such as Slynth (www.slynth.com).

How do I get a Sync License?

Production music publishers will usually license music on what is called a needle drop (a.k.a Drop License) or a Blanket License.

A needle drop or Drop License is a license that requires payment for individual songs. The prices for each song vary depending on the type of production in which the song is being used. The rule of thumb when pricing Drop Licenses is - the larger the audience, the higher the price. (Rate cards can be requested with Drop Licenses.)

A Blanket license is a license that affords a user either a set number of music selections or unlimited use of music selections in any given production. The distinction between a blanket and drop license is a drop is issued for one song, a blanket for many. Obtaining a blanket license involves dozens of variables, so it usually requires some negotiation. Venues such as radio stations or night clubs will often require blanket licenses.

Is A Sync License the Same as a Performance License (Permission from the Musician)?

Unfortunately, no it isn’t. Obtaining a Sync License doesn’t absolve you from getting legal permission from the artist. And, seeing as musicians aren’t known for their knowledge of the legal system, you might imagine that obtaining such a license would be rather difficult. In actuality, the opposite is the case.

The reason for the relative ease of obtaining a Performance License is most musicians are represented by one of two agencies or “performance right societies” that handle the legal jargon. These societies manage the right of performers and see to it that artists get paid when you play their songs in a “public” venue.

Performance rights societies such as ASCAP, BMI and SESAC collect monies for composers and publishers. These societies handle Performance Licenses and should be consulted before you publish any finalized work.

Who needs a performance license?

Anyone who uses copyrighted music in a public place including radio and television stations and/or their networks; all new media, like the Internet and mobile technologies such as ringbacks and ringtones; satellite services like XM and Sirius; discos, nightclubs, bars, restaurants, hotels, and other venues. This includes digital jukeboxes and live concerts. All should obtain a performance license.

What happens if I don’t have a performance license?

Production music users are in danger of copyright infringement without a license from a performing rights organization. If you’re an individual with a small audience and no real money (ie you’re not a business), then you are at lower risk of having suit brought against you for copyright infringement.

However, if you’re an individual with a large audience or you’re a business or organization and you fail to obtain the proper licensing, be prepared to hire a lawyer.

The basic rule of thumb with rich media on your website is this: If you’re going to use audio without a license, make sure no one sees it. This may be a difficult rule for most webmasters to cope with, as the purpose of internet businesses is to be seen. Remember the best choice, if you have a large enough audience, is to be safe and purchase the required licenses.

From Idol to Music Artist

Who would have thought that a young cocktail waitress from Texas would eventually have three music labels? Kelly Clarkson won the first American Idol contest back in 2002, and was awarded with a record deal and the chance at a music career. That is when the Texas native released her first music album, Thankful in 2003. It is no surprise either, that that single music album was so well received. Not only did several of the music hits get number one on many hit-lists; but the album sol over two million copies, and the reviews to go along with it.

It took a long while for her to make it in to the music scene. Before winning "American Idol", Clarkson joined her school's chorus and began singing late in her youth, at age 13. Even back then, her voice was strikingly amazing, and everyone knew that she would one day have her own music labels. After graduating high school the lively young singer with a powerful voice recorded her own songs while holding down numerous jobs. Some of these songs she put onto websites for people to find the music files. But the downloading music sites were not popular enough for her to get noticed. She then moved west to make an attempt at a music career, but as fate would have it, it wasn't her time yet. After a series of mishaps while living in Los Angeles, including an apartment fire that left her with nothing, she returned home to Texas.

Luckily, when she returned home, her friends urged her to enter into the contest, and from there, everyone knows what happened. Clarkson's title choices for her music albums seem to reflect the stages of her career thus far. "Thankful" was released after her Idol win, as she sang her praises to the success of the contest, and the whole experience. But her sophomore effort, Breakaway, symbolic of establishing herself as a successful artist, is free of the ties that bound her to once being a mere contest winner. With "Breakaway" she establishes herself as an independent force in the pop music world. The music album is more hard-edged than her debut and hints of other important pop rock music singers, like Avril Lavigne. But at the end of the day, it’s all Clarkson.

Her Idol appearance proved to the world that she had talent, her first album proved she had a voice. In her second music album, she told the world that she was more than a contest winner. Now Clarkson is now free to shine and to make her own music. Her new music ranges multiple genres with her voice nicely fitting each tune. She hit the Top 10 with the previous music album with several music hits. Highlights from the music album include her number-one hit "Since U Been Gone," "Behind Hazel Eyes," and "Because of You." The latter is a great piano ballad that has the feel of a country-crossover artist. It is perhaps the best song on the disc and showcases Clarkson's great voice.

Although the subject of many of the songs is the cliché "break-up" theme, it's still very good. There are few pre-fabricated sounds like drum machines and synthesizers, but Clarkson's second album does a nice job of proving that she's the real deal, and she will most likely get even better as she matures as a songwriter.

The Game – The R.E.D. Album

Man, where does one start with The Game? Originally a protégé of Dr. Dre, The Game has gone on to alienate and infuriate just about everyone in the rap business with his strange, erratic behavior. There is no doubt that despite being a difficult guy to get along with, The Game is immensely talented, being able to appropriate the best parts of classic era West Coast hip-hop with modern day beatmakers to create something original and fresh. He has reportedly squashed any beef he had with Dr. Dre and Aftermath Records to record several tracks with the legendary West Coast producer that are reported to be included on the new record (and the reason why the record was pushed back.) Here’s hoping for another powerful, strange trip through the mind of The Game, lets just hope he gets some good beats behind him.

Shearwater – The Golden Archipelago

This Austin, Texas indie-rock band is one of the most overlooked bands of the decade. They have been making music since 2001 but it wasn’t until 2004’s “The Winged Life” when they really broke through and reveled themselves as some of the most creative, literate and beautiful songwriters working today. Made up of Jonathan Meiburg and Will Sheff who worked together in the critically acclaimed band Okkervil River, both artists bring their own unique songwriter and singing talents to the group. Their last release, “Rook” was rightfully praised for its baroque instrumentation, otherworldly vocals and powerful lyrical themes. “The Golden Archipelago” is said to be another continuation in a loosely connected theme of albums with “Rook” being the sky and “Archipelago” being the sea.

Pantha du Prince – Black Noise

It is about time that Pantha du Prince breaks through from his niche as a low-key ambient/techno producer and becomes a household name to indie kids, pop kids and techno kids alike. With the look of his newest release, “Black Noise”  to be released on the powerful Rough Trade record label, as well as thanks to guest appearances from Noah Lennox of Animal collective and members of LCD Soundsystem and !!!, Pantha du Prince will likely get his best reviews and exposure ever, and he deserves it. His last record from 2007, “This Bliss” is still considered one of the darkest and most beautiful minimal techno albums of the decade so many have high hopes for “Black Noise” to up the ante and reach new heights.

With their self titled debut in 2006 making waves thanks to its lo fidelity recording and its reliance on little more than a drum machine, keyboard and powerful melodies, the band has slowly begun inching towards a more studio produced sound with their second release “Devotion” taking their dream pop to new heights. Their third record, “Teen Dream” is their first for legendary indie rock record label Sub Pop and features even more beautiful, sad, mysterious music from the duo known as Beach House.
